AN ACT TO AMEND G.S. 130-124 SO AS TO ELIMINATE THE REQUIREMENT THAT FREEHOLDERS PETITIONING FOR INCORPORATION OF A SANITARY DISTRICT BE RESIDENTS OF THE PROPOSED DISTRICT.

 

The General Assembly of North Carolina do enact:

 

Section 1. G.S. 130-124 is hereby amended by rewriting the second sentence thereof to read as follows:

"Either fifty-one per cent (51%) or more of the resident freeholders within a proposed sanitary district, or fifty-one per cent (51%) or more of the freeholders within a proposed sanitary district, whether residents therein or not, may petition the board of county commissioners of the county in which all or the majority portion of the land of the proposed district is located, setting forth the boundaries of the proposed sanitary district and the objects it is proposed to accomplish."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective upon its ratification.
