AN ACT TO AMEND THE CHARTER OF THE CITY OF ROCKY MOUNT.

 

The General Assembly of North Carolina do enact:

 

Section 1. Subsection (c) of Section 10 of the Charter of the City of Rocky Mount as contained in H. B. 1058 ratified by the 1963 General Assembly, June 14, 1963 (Chapter 938, 1963 Session Laws) is hereby amended by adding thereto the following:

"In the regulation of the use of dynamite or other dangerous explosives within the corporate limits of the City or within one mile thereof, to issue permits for the same and to require as a condition precedent to the issuance of such permits that every prospective user of dynamite or other dangerous explosives shall furnish and keep in effect at all times when engaged in such use a policy or policies of liability insurance providing coverage on the part of such user for damages due any person whose person or property is damaged as the result of such use in such amount as may be fixed by the City Council but not to exceed the sum of twenty-five thousand dollars ($25,000.00) for injury suffered by any one person or damage done to any single property and twenty-five thousand dollars ($25,000.00) for injuries suffered or damages done from any single use; and further to provide for the legal liability of such user to any person whose person or property is damaged as a result of blasting within the above described area irrespective of negligence on the part of such user."

Sec. 2. All laws and clauses of laws in conflict herewith are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
