AN ACT TO AMEND G. S. 113-223 TO PROVIDE PROTECTION TO PLANTED OYSTER GROUNDS.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 113-223 is amended by adding a new sentence at the end thereof to read as follows:

"It shall be unlawful for any person, firm or corporation to take or attempt to take fish, crabs, shrimp, clams, or other seafood from the waters over marked oyster beds which have been planted or closed, during the period for which they have been closed: Provided, this prohibition shall not apply to the use of crab pots, hand lines, trot lines, drop nets, set nets or any type of sport fishing with rod and reel and/or hook and line; provided this Act shall not apply to the County of New Hanover."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
