AN ACT TO AMEND CHAPTER 47 OF THE GENERAL STATUTES RELATING TO PLATS, SUBDIVISIONS AND LAND SURVEYS AND RECORDING OF SAME.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 2, of Chapter 47 of the General Statutes, is hereby amended by adding a new Section, to be designated as G.S. 47‑30.1, and to read as follows:

"G.S. 47‑30.1.  Plats and subdivisions; alternative requirements. In a county to which the provisions of G.S. 47‑30 do not apply, any person firm or corporation owning land may have a plat thereof recorded in the office of the register of deeds if such land or any part thereof is situated in the county, upon proof upon oath by the surveyor making such plat that the same is in all respects correct according to the best of his knowledge and belief and was prepared from an actual survey by him made, giving the date of such survey, or if the surveyor making such plat is dead, or where land has been sold and conveyed according to an unrecorded plat, upon the oath of a duly licensed surveyor that said map is in all respects correct according to the best of his knowledge and belief and that the same was actually and fully checked and verified by him, giving the date on which the same was verified and checked."

Sec. 2.  Any plat recorded in accordance with the provisions of G.S. 47‑30.1 in a county to which the provisions of G.S. 47‑30 do not apply, between December 31, 1959, and the effective date of this Act, is hereby in all respects validated and confirmed.

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall be in full force and effect from and after its ratification.
